Warranty and Limitation of Liability

Sale Terms and Conditions Policy 

1. Limited Warranty Coverage

Rocky Mountain Tents Co. (“RMT Co.”) provides a limited, non-transferable warranty to the original purchaser covering defects in materials and workmanship under normal and intended recreational use. Warranty coverage begins on the original date of delivery. Structural components, including the frame, base, and hard shell, are covered for a period of one (1) years. Fabric components, including canvas, rainfly, and stitching, are covered for a period of one (1) year. All other components, including but not limited to ladders, hinges, gas struts, zippers, and mounting hardware, are covered for a period of one (1) year. At its sole discretion, RMT Co. may repair the product, provide replacement parts, or replace the product where deemed necessary. Replacement parts shall be the primary method of warranty resolution.

2. Warranty Exclusions

This warranty does not cover normal wear and tear, cosmetic damage including scratches, fading, dents, or discoloration, UV degradation, environmental exposure, mold, mildew, or moisture-related damage. This warranty further excludes any damage resulting from wind, storms, snow load, water pooling, extreme weather conditions, improper installation, improper mounting, use with incompatible vehicles or roof rack systems, off-road use, excessive vibration, impacts, accidents, misuse, neglect, unauthorized modifications or repairs, improper storage, or improper cleaning. Outdoor exposure and environmental wear are inherent to rooftop tent use and shall not be considered defects in materials or workmanship.

3. Installation and Compatibility Responsibility

The purchaser assumes full responsibility for verifying compatibility between the rooftop tent, vehicle, and roof rack system, as well as for ensuring proper installation, correct torque of all mounting hardware, and ongoing inspection and maintenance. RMT Co. makes no representations or warranties regarding compatibility with any specific vehicle or rack system. Under no circumstances shall RMT Co. be liable for improper installation, rack or vehicle failure, damage to any vehicle, or any incident arising from a product becoming loose, detached, or failing due to installation error or improper use.

4. Use at Your Own Risk

Rooftop tents and related equipment involve inherent risks, including but not limited to vehicle damage, structural failure, personal injury, or death, as well as damage caused by weather, wind, or environmental conditions. By purchasing or using any product from RMT Co., you acknowledge and agree that all use is entirely at your own risk, that you assume full responsibility for installation, setup, and operation, and that RMT Co. does not supervise, inspect, or verify the use or installation of any product.

5. Warranty Claim Process

To submit a warranty claim, the purchaser must provide valid proof of purchase, clear photographs and/or videos of the alleged defect, and a detailed written description of the issue. RMT Co. reserves the right to request additional documentation, including photos or videos of the installation and mounting setup, and to require further diagnostics prior to approving any claim. All claims must be submitted via email to rockymountaintents@gmail.com. Failure to provide sufficient information may result in denial of the claim.

6. Shipping and Service Terms

Unless otherwise approved in writing, the purchaser is responsible for all shipping costs associated with warranty claims. If a product must be returned for inspection, repair, or replacement, the purchaser is typically responsible for shipping costs in both directions. Where RMT Co. provides a return shipping label, the cost of such label may be deducted from any refund, credit, or replacement issued. RMT Co. reserves the right to provide replacement parts in lieu of requiring a full product return.

7. Warranty Disclaimer

THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED BY ROCKY MOUNTAIN TENTS CO. AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RMT CO. EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

8. Indemnification

You agree to indemnify, defend, and hold harmless Rocky Mountain Tents Co., its owners, officers, employees, affiliates, suppliers, manufacturers, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including legal fees, arising out of or related to product use or misuse, improper installation, failure to follow instructions, personal injury, death, property damage, or any violation of this policy or applicable laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKY MOUNTAIN TENTS CO. SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, VEHICLE DAMAGE, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF USE, INSTALLATION OR REMOVAL COSTS, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RMT CO. SHALL NOT BE LIABLE FOR ANY THIRD-PARTY CLAIMS OF ANY KIND.

10. Maximum Liability

UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF ROCKY MOUNTAIN TENTS CO. EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT.

11. Risk Allocation

You acknowledge and agree that the limitations of liability and disclaimers set forth herein reflect a fair and reasonable allocation of risk between the parties and form an essential basis of the agreement between you and RMT Co. You further agree that these limitations shall apply regardless of the failure of any essential purpose of any limited remedy.

12. Product Use Limitation

Products sold by Rocky Mountain Tents Co. are intended strictly for recreational camping use. They are not designed, tested, or intended for permanent housing, commercial occupancy, extreme weather or survival conditions, or any use beyond their stated capacity or intended purpose. Any such use is strictly at the purchaser’s own risk.
