Safety & Installation Waiver

IMPORTANT: PLEASE READ CAREFULLY BEFORE INSTALLING OR USING ANY PRODUCT.

This Safety & Installation Waiver (the “Waiver”) applies to all products sold by Rocky Mountain Tent Co. (the “Company,” “We,” “Our,” or “Us”), including but not limited to rooftop tents, mounting systems, ladders, accessories, and related equipment (collectively, the “Products”).

By purchasing, installing, or using any Product, you (“You” or the “User”) acknowledge and agree to the following terms:

1. Assumption of Risk

You acknowledge that the use of rooftop tents and related equipment involves inherent risks, including but not limited to vehicle damage, equipment failure, improper installation, falling from height, structural collapse, shifting loads, environmental hazards, severe weather conditions, personal injury, and death. You voluntarily assume all risks, known and unknown, associated with the purchase, installation, and use of the Products.

2. Installation Responsibility

You acknowledge and agree that You are solely responsible for ensuring that the Product is properly installed. This includes, without limitation, verifying compatibility with your vehicle, roof rack, crossbars, mounting hardware, and load ratings. Improper installation may result in serious injury, death, or damage to property. Rocky Mountain Tent Co. does not install Products and assumes no responsibility for installation errors or outcomes.

3. Vehicle and Load Responsibility

You acknowledge that You are solely responsible for ensuring that your vehicle and roof system are capable of supporting the weight of the Product, including dynamic and static loads. You agree to verify all manufacturer specifications for your vehicle and rack system and understand that exceeding load limits may result in failure, accidents, or injury. Rocky Mountain Tent Co. makes no guarantees regarding compatibility or weight capacity.

4. Proper Use and Environmental Conditions

You agree to use the Product only for its intended recreational purpose and in accordance with all instructions and safety guidelines. You acknowledge that weather conditions, including wind, snow, rain, and temperature, can significantly impact safety and performance. Use of the Product in extreme or unsafe conditions is done entirely at your own risk.

5. Inspection and Maintenance

You agree to regularly inspect all components of the Product, including mounting hardware, structural elements, ladders, and fabric, before and during use. You acknowledge that failure to properly maintain or inspect the Product may result in failure, injury, or damage, and You assume all risks associated with such failure.

6. No Professional Advice

Any guidance, instructions, videos, or information provided by Rocky Mountain Tent Co. is for general informational purposes only and does not constitute professional installation advice. You are responsible for seeking qualified assistance if required.

7. Release of Liability

To the fullest extent permitted by law, You hereby release, waive, discharge, and hold harmless Rocky Mountain Tent Co., its owners, officers, employees, affiliates, suppliers, manufacturers, and agents from any and all claims, demands, damages, losses, liabilities, costs, or expenses, including legal fees, arising out of or related to the purchase, installation, or use of the Products, including but not limited to claims involving personal injury, death, property damage, or product failure.

8. Indemnification

You agree to indemnify, defend, and hold harmless Rocky Mountain Tent Co. from any claims or damages brought by third parties arising from your use, misuse, installation, or operation of the Product.

9. No Guarantees or Warranties

All Products are used at your own risk. Rocky Mountain Tent Co. makes no representations or warranties regarding safety, performance, or fitness for a particular purpose beyond any express written warranty provided with the Product.

10. Binding Agreement

This Waiver constitutes a legally binding agreement. By using the Product, You acknowledge that You have read, understood, and agreed to all terms contained herein.
